I have a legal opinion I would like to ask:

If you see someone loitering on the road, and you have the capability to hit the brake.

Yet you decided not to hit the brake and kill the guy/lady.  Instead, you decided that they derserve it and just 'override' him/he, instantly killing him/her.  Did you just commit murder?
